WILMINGTON, NC (WECT) - A man accused of sodomizing a child pleaded guilty recently to attempted sex abuse of a child under the age of 12, according to Nicki Patterson, Assistant District Attorney in Mobile, AL.
Brion Capo, the City of Wilmington's Urban Arborist, pleaded guilty Nov. 29 and was sentenced the same day to serve two years in jail. He will also be on probation for five years. He resigned from his position with the City Jan. 3, 2013.
Capo was arrested early last summer on a fugitive warrant from Mobile, AL.
Capo was extradited from the New Hanover County jail and transported to Mobile, where he made bond. His combined bond amount for sodomy and first degree sex offense against a child was $22,500.
WECT later learned that the alleged crimes occurred over a period of seven years - and overlap the time of Capo's employment with the City of Wilmington. Wilmington hired Capo in 2006, and his current salary is $53,000. He used vacation time while in custody for the sex crimes, and returned to work on July 23rd.
The victim – whose relationship to Capo is unclear – says the crimes occurred in Mississippi, Alabama, and North Carolina.
